1. Acceptance of Terms
By creating an account, installing our Chrome extension, or using any of our services, you agree to these Terms of Service, our Privacy Policy, and any additional terms that may apply. If you do not agree to these terms, you may not use Curate.
2. Description of Service
Curate is an AI-powered fashion platform that provides virtual try-on, digital wardrobe management, personalized styling recommendations, and cross-retailer product discovery through a Chrome browser extension and web application. Our services use artificial intelligence including Google Vertex AI and Gemini to generate virtual try-on images and process wardrobe photos.
3. Account Registration
You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.
4. User Content and Photos
By uploading photos to Curate, you grant us a limited, non-exclusive license to process, store, and use those images solely for the purpose of providing our services to you (e.g., virtual try-on generation, wardrobe analysis). You retain all ownership rights to your photos. We do not sell, share, or use your photos for any purpose other than delivering the service. You may delete your photos and data at any time.
5. Subscriptions and Payments
Curate offers free and paid subscription plans. Paid subscriptions are billed monthly and auto-renew unless cancelled. You may also purchase one-time credit packs that do not expire. All payments are processed securely through our payment provider. Refunds are handled on a case-by-case basis — contact us at hello@curatefashions.com for any billing issues.
6. Acceptable Use
You agree not to: use our services for any unlawful purpose; upload content that is offensive, harmful, or infringes on others' rights; attempt to reverse-engineer, decompile, or exploit our AI models or proprietary technology; use automated tools to scrape or access the service beyond normal usage; or interfere with the proper functioning of the platform.
7. Intellectual Property
All content, features, and functionality of Curate — including the AI models, Chrome extension, website, branding, and design — are owned by Curate and protected by intellectual property laws. Virtual try-on images generated by our AI are provided for your personal, non-commercial use only.
8. Third-Party Services
Curate integrates with third-party retailers and services. We are not responsible for the products, pricing, availability, or policies of any third-party retailer. Product information displayed through our extension is sourced from retailer websites and may not always be up to date.
9. Limitation of Liability
Curate is provided "as is" without warranties of any kind. We do not guarantee that virtual try-on results will perfectly represent how a garment will look or fit in person. To the maximum extent permitted by law, Curate shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms. You may cancel your account at any time. Upon termination, your right to use the service ceases immediately, and we may delete your data in accordance with our Privacy Policy.
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our website. Your continued use of Curate after changes are posted constitutes your acceptance of the revised terms.
